1. What OddsExchange is — and is not

OddsExchange is a sports-odds data and analytics platform. We aggregate, normalize, and display betting odds published by third-party sportsbooks, and we provide tools, calculators, model estimates, and an API built on that data. We are not a sportsbook: we do not accept, place, broker, or settle wagers; we hold no customer funds; and no balance, deposit, or withdrawal facility exists on this platform. Nothing here is betting, financial, legal, or tax advice.

2. Eligibility

You must be at least 21 years old to create an account. You are responsible for ensuring that your use of odds data and any related betting activity is lawful in your jurisdiction, and you use the service at your own risk.

3. Accounts

Registration requires a valid email address, date of birth, phone number, and acceptance of these Terms and the Liability Waiver. You are responsible for safeguarding your password and any API keys issued to your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that provide false registration details, at our sole discretion.

4. Subscriptions and billing

Paid tiers are billed monthly in advance through our payment processors (Stripe; PayPal where offered). New accounts may receive a one-time free trial; when a trial ends without a paid subscription, the account continues on the free tier. You can cancel at any time from the billing portal; access continues until the end of the paid period. Fees are non-refundable except where required by law.

5. API and acceptable use

API access is rate-limited per plan tier. You may not, directly or through any automated means: resell, sublicense, redistribute, or publicly display our data, model outputs, or API responses without our prior written permission; circumvent rate limits, plan gating, paywalls, or key authentication; scrape, crawl, cache, or bulk-download the storefront in lieu of the API; or use the service to build a competing product or to operate an unlicensed gambling product. We may revoke keys or throttle traffic that degrades the service for others, at our sole discretion.

6. Data accuracy

Odds change constantly and sportsbooks correct errors. Data is provided "as is" and "as available", may be delayed, incomplete, or wrong, and must be verified with the sportsbook before placing any wager. See the Liability Waiver for the risk acknowledgement you accept at signup.

7. Intellectual property

The platform, its design, software, compiled datasets, and our proprietary models — including the house fair-value figures, pick'em spreads, and any derived analytics — are ours or our licensors' and are protected by intellectual-property law. Sportsbook names and marks belong to their owners and appear for identification only. Your plan grants a limited, revocable, non-exclusive, personal (or, on commercial tiers, internal-business) license to use the data — not ownership, and not a right to redistribute. All rights not expressly granted are reserved.

8. Disclaimer of warranties

To the maximum extent permitted by law, the service and all data, model estimates, and content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any estimate, projection, or "fair value" will be accurate or profitable.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the greater of the fees you paid us in the twelve months before the claim or US $100. We are not liable for betting or trading losses, lost profits, or indirect, incidental, special, punitive, or consequential damages, even if advised of their possibility.

10. Indemnification

You agree to defend, indemnify, and hold harmless OddsExchange and its owners, officers, employees, and licensors from and against any claims, damages, liabilities, costs, and attorneys' fees arising out of your use or misuse of the service, your breach of these Terms, your violation of any law or third-party right, or any content or data you submit or redistribute.

11. Governing law, arbitration & waivers

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. To the maximum extent permitted by law, you and OddsExchange agree that any dispute arising out of or relating to the service or these Terms will be resolved by final and binding individual arbitration, and you waive any right to a jury trial and to participate in any class, collective, or representative action.

You further agree that OddsExchange may, at its sole discretion, designate the seat, venue, forum, rules, and administrator of any arbitration or proceeding — in any jurisdiction anywhere in the world — and you waive any objection to that choice on grounds of inconvenient forum or otherwise, to the fullest extent the law allows. Any claim must be brought within one year of when it arose, or it is permanently barred.

12. Termination and changes

You may close your account at any time. We may suspend or terminate access at our sole discretion, with or without cause. We may modify these Terms with notice posted on this page; continued use after the effective date is acceptance. Material changes to paid features will be notified by email.

13. General

If any provision is held unenforceable, the rest remains in effect and the provision is enforced to the maximum extent permitted. We may assign these Terms (e.g., in a merger or sale of assets); you may not assign them. We are not liable for failures caused by events beyond our reasonable control (force majeure). Our failure to enforce a provision is not a waiver. These Terms and the Liability Waiver and Privacy Policy are the entire agreement between you and us regarding the service.
